Welcome to our Privacy Policy. Momsezeis a specialized telehealth solution that connects new parents with certified lactation consultants and new baby support specialists 24/7/365.
The Privacy Policy explains how we collect, use, disclose, and secure information we obtain through the “Service.” The terms“Momseze,” “we,” and “us” include Momseze Inc. and our affiliates and subsidiaries. This Privacy Policy is incorporated by reference into our Terms of Use. Any capitalized terms used and not defined in this Privacy Policy shall have the meaning given to them in the Terms of Use.

THE SERVICE COLLECTS YOUR INFORMATION

We collect information when you:

  • register to use the Service;
  • participate in a consultation;
  • respond to surveys or post comments or reviews;
  • otherwise visit or use the Service; and communicate with us.

We also collect information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Service.

Registration and Account Information. You must register to use the Service. To register, you willneed to provide information, such as your name, zipcode, email address, and telephone number. You may also provide other optional information, such as the name of other parents or caretakers, baby’s due/delivery date, baby’s name, and names and telephone numbers of pediatricians or other healthcare providers.

Using the Service. We collect information you provide through the Service. For example, when you interact with other users or consultants by videoconference or text conversations or when setting up an appointment, the Service will collect the information you provide in such submissions. During a session with a consultant, information about the mother and baby’s health and well-being may be documented by the consultant, including information about the mother’s birth experience, specifics regarding her breasts, her baby’s current weight, the baby’s weight at birth, the appearance of the baby (e.g., healthy, jaundice), and the baby’s oral issues including tongue tie. This information may be documented and made available to subsequent consultants helping the mother for continuity of care purposes.

Recording Video Conferences and Voice and Text Conversations. The Service allows you to record a video conference session with a consultant. These recordings will be stored in your profile so you can access them. The recordings will not be available to consultants or other users. We may also monitor and/or record video-conferences,voice conversations, and text messages that are sent or occur on or through the Service for our business purposes, such as quality assurance and training purposes and to protect our rights and the rights of others.

Making Payments. When you make payments through the Service, you willneed to provide financial account information, such as your credit card number, to our third-party service providers. We do not collect or store such information, though we willreceive information about completed transactions that does not include credit card or bank account numbers.

Surveys, Reviews, and Comments. We may receive information when you participate in surveys and post comments and reviews. We may post your anonymized comments and reviews on the Service and on other websites and online services, such as on our social media pages.

Referrals. A user may submit contact information, such as an email address, about others to us so that the user can recommend the Service or content available on the Service to them. We use the information to send a communication to the individual and then delete the information.The recipient of an invitation to use the Service willsee your name and email address as the referrer.
Communications with Us. We collect information about you through your communications with our customer-support team or through other communications with us, including through social media.

Location Information from Your Mobile Device. We collect and store your geo-location information if your device settingsare enabled to send it to us. We also infer your location from your IP address and other data. We use this information to provide and improve the Service, such as to match users with nearby consultants or doctors or to display nearby businesses that have facilities conducive to nursing babies. We retain the most recent location we collect from you.

Information and Content that You Select from Your Device.If you choose to share your photos through the Service, with your permission, we will access the photos you select from your device’s photo storage.

Automatic Data Collection: Cookies and Related Technologies.When you visit ourService or open our emails, we and our third-party partners, such as advertising networks, social media widgets, and analytics providers, collect certain information by automated means, such as cookies, web beacons and web server logs. By using the Service, you consent to the placement of cookies, beacons, and other similar technology in your browser and on emails in accordance with this Privacy Policy. The information collected in this manner includes IP address, browser characteristics, device IDs and characteristics, operating system version, language preferences, referring URLs, and information about the usage of our Service. We may use this information, for example, to determine how many users have visited certain pages or opened messages or newsletters, to send push notifications, or to prevent fraud. You may be able to change browser settings to block and delete cookies when you access the Service through a web browser. However, if you do that, the Service may not work properly. The Service does not respond to browser do-not-track signals.

HOW MOMSEZE USES YOUR INFORMATION

  • facilitate and improve our services;
  • process transactions;
  • communicate with you, including for marketing purposes; and
  • facilitate user communications among themselves.

We may use anonymized information for any purpose, including for research and marketing purposes

Internal and Service-Related Usage. We use information for internal and service-related purposes. We use and retain data we collect to provide and improve any of our services. For example, we use information to manage your account, subscriptions, and appointments, to ship you products you have purchased, and to help facilitate communications among mothers and consultants.

Communications from Us. We may send emails to the email address you provide to us, push notifications to your mobile device if you have enabled notifications, and text messages to any cellphone number you provided to us, to verify your account and for informational and operational purposes, such as account and appointment management, transaction processing, sending you session overviews and reminders,customer service, system maintenance, and other Service-related purposes.By using the Service, you are agreeing to receive Service-related communications via these methods.

Communications among Users. The Service also facilitates communications among users. For example, parents and consultants communicate using video conference calls, Internet-based voice calls, and text-based messages using technology provided by the Service. By using the Service, you are agreeing to receive communications via these methods.Text-based conversations between parents and consultants and the notes taken by the consultant during video and voice callsare stored and made available to subsequent consultantsfrom whom parentsobtain advicefor continuity of care purposes. These messages are only available to a consultant after a parent and consultant have agreed to have a consultation.

Marketing. We may use information about you to provide online advertising on the Service and to send you information from us and third partieswe think may be useful or relevant to you. You may opt out of email marketing by using the unsubscribe link in a marketing email.

Aggregate Data. We anonymize or aggregate data collected through the Service and use and disclose it for any purpose, including research and marketing.

MOMSEZE MAY DISCLOSE YOUR INFORMATION

We may share information:

  • with our third-party vendors and service providers;
  • with other users;
  • to support our advertising and marketing efforts;
  • to comply with legal obligations;
  • to protect and defend our rights and property; and
  • with your permission.

We do not rent, sell, or share personal information about you with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.

We Use Vendors and Service Providers. We share information we receive with vendors and service providers we use to help us provide and improve the Service.For example, we will provide information to service providers that provide web and database hosting services and communications technology like text messaging and video-conferencing services.

Sharing Between Mothers and Consultants. Profile information about a mother, including name, delivery date, baby’s name, city, information about the mother’s request, and consultants’ notes and text conversationsfromthe mother’s prior consultations through the Servicewill be available to a consultant aftera parent and consultant agree to have a consultation. Profile information about consultants will be available to parents using the Service.

Sharing Among Mothers. In any community or public features of the Service, a mother’s nameand any information specifically shared by a motherwill be viewable by other users on the Service.

Social Networking Websites. The Service may allow you to share information with social networking websites, such as Facebook. Their use of the information will be governed by their privacy policies, and we are not responsible for how they treat the information.

Marketing. We do not rent, sell, or share personal information (as defined by California Civil Code §1798.83) about you that we collect on the Service with other people or unaffiliated companies for their direct marketing purposes, unless we have your permission. We allow access to data collected by the Service to enable the delivery of online advertising to you and others on the Service, or to sendyou information we think may be useful or relevant to you.

Legal and Similar Disclosures. We may access, preserve, and disclose collected information if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; comply with the law; or protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be disclosed in connection with the negotiation of such transaction, and/or sold or transferred as part of such a transaction as permitted by law and/or contract. We cannot control how such entities may use or disclose such information.

CHILDREN’S PRIVACY

If you learn that your child has provided us with personal information without your consent, you may alert us at help@momseze.com. If we learn that we have collected any personal information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.

INTERNATIONAL USERS

By using the Service, you will transfer data to the United States.

If you are using the Service, you agree to the transfer of your information to the United States and processing globally. By providing your information you consent to any transfer and processing in accordance with this Privacy Policy.

UPDATE YOUR INFORMATION OR POSE A QUESTION OR SUGGESTION

You may use the Service to update your profile information and delete any video recordings that you made on the My Profile screen. If you choose to delete your account, we will remove from the Service your profile information and recordings, though such information may remain in backup files. We may keep anonymized consultant notes and text communications during consultations for our business purposes, such as for research. We will remove your name from any comments, reviews, or posts you may have made in public areas of the Service, but we will not delete them so that we can maintain the integrity of the related comments, reviews, and posts made by other users.
If you would like to request that we update or correct any information that you have provided to us through your use of the Service or otherwise, or if you have suggestions for improving this Privacy Policy, please send an email to help@momseze.com.

CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may revise this Privacy Policy, so review it periodically.
